That's my understanding of the process. We have about 5 early models in production being manufactured/built/tested (from what I'm told) and then those early models would be sent to backers. Unfortunately, I don't know the exact order they're shipping to the backers in. We'll have to review that when we get to the shipping part and make some sort of determination over how the list would be handled.

Can I request that you report on this forum as soon as the first of the "five early models in production" is shipped and an update when all 5 are shipped, then progressive updates until all have been shipped?

 

As far as I'm aware the only remaining obstacle to shipping Vi DACs was the chassis issue and now that has been resolved I assume we can expect a steady stream going out to backers.

 

I and (from what I've heard) many others have already paid for shipping so that shouldn't be a barrier to delivery.

 

Are my expectations here reasonable?

Shipping should/will be covered for most people at this point due to the earlier shipping payments Gavin initiated.

The complaint to the California State AG has gone through fact gathering and numerous drafts that have circulated among the authors.  We expect to finish it sooner than LH ships its next product.  We have determined that, due to various jurisdictions' rules governing transmission of personally-identifiable information, we cannot identify the names of people who want to join in the complaint, but we definitely will include as an appendix a copy of the spreadsheet with the various claimants' loss listing.  We also will let everyone know what and where we file.  Then, people can choose to refer to the filing if they care to make their own submissions incorporating ours.  Be aware, though, that we are asking for relief for everyone who paid into the crowdfund, even if not identified in the complaint individually.

 

On a lighter note, I opened a ticket at LH for a Pulse Fi firmware update, to see if later revs allow me to play native DSD in JRiver Media Center.  (I seem only to be able to play DSD as DoP.)  I know from Jarek's posts here that no one is responding to LH tech support requests at all right now, but I nonetheless got this response:

"We would like to acknowledge that we have received your request and a ticket has been created.

"A support representative will be reviewing your request and will send you a personal response.(usually within 24 hours).

(1). We will circulate the final draft of the document by email to those who provided information for the spreadsheet.

 

(2). Recipients of the draft will have about a week to review and decide whether to join in the filing.  Anyone who wants to join in the filing will forward an authorization both for me to sign on his or her behalf and to utilize the personally-identifiable information that he or she provides.

 

(3).  After great effort to edit this document into the most precise and accurate document that we can create and to avoid further delay, we will not entertain requests for additional edits for any reason other than to address inaccuracies.  If someone does find an error and we correct it in a revised draft, we will circulate the revised draft to everyone before filing with the California State Attorney General.  Anyone who doesn't like what we have created is free to file a complaint on his or her own.  We will furnish State Attorney General contact information and I can refer you to the Attorney General website page that specifies the required information.

Well... at the moment I can't post anymore at HF ("awaiting Moderator approval") hence I like to remind you here again how you can participate in the spreadsheet:

 

i) Request access

In case someone is requesting access via the link to the Google sheet (see my signature) I either get in touch with him/her explaining that I need some further information and/or confirming that he/she has been added to the list. 

 

ii) Providing information via email 

Another option is to contact me directly via email at defraudedbylhl AT Gmail DOT com. 

 

iii) Providing information via PM

Last but not least the required info can also be provided via PM (here or Headfi) although I need an email anyway (for sharing further updates regarding the complaint). 

 

Regarding the info which needs to be provided:

• user name (either the one from IGG or any other forum such as Audiophilestyle etc
• current home country and of course
• the total price (including all its upgrades and shipping costs) which has been paid for each device (e. g. WAVE 128 $xxx, ViDac Tube $y, xxx,...)

Quick remark:

A lot of persons click on the request button of the Google sheet adding some info such as "would like to have access". 

Then I send them an email mentioning that I don't grant access to anyone to avoid that the sheet will get harmed and asking for the info aforementioned.

Usually they respond back with the requested information hence I'll add them to the list. 

 

But there are also others who went "silent" after I dropped them the email. Hence those guys won't be included in the distribution list of the finalized complaint due to the fact that I couldn't add them to the list because of the missing info.

Their staff is also very involved with threads (especially the LH threads) and will knock out any posts they see that go against the rules or TOS there. That's why the place is (generally) so civil and tightly organized. Because they hawk over it relentlessly.
